Roles in the Courtroom Essay Everyone has been in or seen a courtroom. If not personally, they have definitely seen one on television. Shows like Law Order and the First 48 gives the generalization of how a criminal is caught, brought to justice and itââ¬â¢s done all within one hour. Then there are civil court shows like Judge Judy and Judge Mathis, where you can see what actually happens in a court of law when someone is sued. All in all, when you watch these shows you never get the full effect of the roles each person in a courtroom plays to bring a person to justice. Some roles are more important than others, but people like Bailiffs, Judges or even Jurors all share an amount of responsibility in making sure that justice is served. In any courtroom you will see a Bailiff, Prosecutor, Defense Attorney, and a Judge. The Bailiff is usually a sheriff or a high- ranking police officer. Their presence alone keeps order in the courtroom amongst the audience all the way to the judge. A Bailiffââ¬â¢s role is simple. They swear in witnesses and they also play the go between man with the judge and jury. They call court to order and announce when the Judge enters the room. Their role is minimal but important still in its own way. Next are the Defense Attorney and the Prosecution whose duties and responsibilities are basically the same. They must gather and present evidence to the jury to discredit or give reasonable doubt that a crime was or wasnââ¬â¢t committed. The Defense is there to advice his client on the right plea to take. He is also there to make sure his client understands what is going on and make sure his client gets a fair and speedy trial. Other than that their duties are the same. They both are there to discredit the other. They both participate in jury selection and establish witnesses that will benefit their case. Both are responsible for presenting their case to the Judge and Jury, but if the case never reaches a trial itââ¬â¢s usually due to both sides plea-bargaining. This is ultimately the Judges decision but is usually the reason why some cases donââ¬â¢t go to trial. The Judge has a key role in the criminal justice system. He is elected into office by his peers and is ultimately the last person to make any decision in regards to a case. Although they donââ¬â¢t say much a Judge has a lot of duties and responsibilities and is one of the most important people needed in a courtroom. They are there from start to finish in any case. At the preliminary hearing they are responsible for making sure the accused is aware of their rights, they enter a plea of either guilty, not guilty or no contest, and the Judge also sets the bail. During the trial they decide what evidence will be allowed. Their understanding of the law is important when keeping order and how the court proceedings will be handled. During the trial the judge makes sure the accused rights arenââ¬â¢t violated. The Judge also makes sure that the jury understands what a person is charged with whether it is First ââ¬âdegree or second-degree murder. It is the Judges responsibility to make sure the Jury knows the difference. Last but not least they have control over the sentencing. This is the most important part aside from the Jury decision on whether or not the accused is guilty. Although The Judgeââ¬â¢s role and responsibility seems to be the most important in the court, it is the role and respon sibility of the Jury that is needed more than anything. Everyone has the right to a trial by an ââ¬Å"impartialâ⬠jury, which means that the trial will be fair. To be fair, some believe a person must be tried amongst a group of oneââ¬â¢s peers. This means that they are from the same community/area. Sex, race and ethnicity have no bearings in any case, as far as jury selection. Juryââ¬â¢s bring diversity, different perspectives and views. It is up to the Defense and the Prosecution to make sure the right people are chosen, and that they will be more in favor of their case when presented in court. This is why Jurorââ¬â¢s must go through a jury selection. People who will be beneficial to either the Prosecutions or Defenses case are kept and those who appear to have no bearings on the case arenââ¬â¢t selected. Once on the Jury they are given instructions by the judge on how the case will go, what they are to listen for, and what a person is charged with. Then they listen to the case and they are to determine if the accused i s responsible for their actions by a reasonable doubt. Meaning if there is any doubt in their mind that the accused is innocent, then the doubt is placed, and either they must be convicted of a lesser crime or the case must be dismissed period. All the evidence and witnesses presented in court is done with wondering how the jury will perceive it. Their impression on the evidence has the greatest impact and is ultimately what will determine the fate of the accused in all cases. That is why it is important that the Judge gives the verdict choices to the Jury and that he makes sure that the Jury understands them when they go to deliberate. They then return and give their verdict of guilty, not guilty to the offense the accused was charged or to a lesser charge period. Anyone can see that the Jury is important in any court proceedings. Juryââ¬â¢s will always have a key role in the court system and their role is most important. There are many roles and responsibilities in the court system. There are bailiffs, prosecutors, defense attorneys but the most important is the jury. Their roles and responsibilities are important and are needed to ensure that the criminal court system is run appropriately. That is why there is so much put into jury selection. They are the deciding factor in determining how long a person will be spending of their life in jail.

Aim and Objectives of research work The aim and objectives of this research is to develop a soft computing based model for trip production, trip attraction mode-wise traffic pattern in Delhi Urban area keeping in view the development polices of the Delhi Master Plan 2021. The proposed model will greatly help in analytical study of the resulting traffic pattern and its forecasting for future city plans. For modeling and analysis of urban transportation system, Delhi has been selected as the study zone. Data on urban activities and traffic flow was collected from the concerned agencies. Delhi, being the Capital of India, is the main center of socio-economic, political as well as cultural activities of the country. Delhi acts as a major center of trade and commerce. The major share of travel needs of Delhi commuters is road based transport system. 4. Literature Review This section focuses on the review of Literature for the study. It is comprises of the topics, related to general facts about the urban transport system. The early trip generation models, based on aggregate data, predicted total trips between city pairs. The modeling methods generally include regression models, cross-classification analysis, or a combination of both. These methods still have applications due to their mathematical feasibility, data availability, and ease of interpretation (USDOT, 1999). Kiron Chatterjee and Andrew Gordon (2006), focuses on the alternative for the Great Britain future scenarios in the year 2030 and the implications they have for transport provision and travel demand. Kiron Chatterjee and Andrew Gordon (2006) develop a National transport model to predict the national road traffics. In order to take income as a constraint for estimating trip generation there is no mathematical model under this aspect. Also, in the developing countries like India wide income disparity is there which can also plays a leading role in trip generation process. Gravity models are signifying the idea of establishing trip distributions process. In Gravity model, the entries of the Origin-Destination matrix are understood to be a feature of the trip counts and other parameters. The main problem of the gravity model is in the measurement of travel cost. This model has been corroborated numerous times as a basic underlying aggregate association (Levinson and Kumar 1995). For the analysis zones separated by a sizeable distances, the gravity model can work properly. But, the denominator approaches to infinity as the distance between locations decreases. In year 1947, Dantzig created the Linear Programming problem as well as offered the simplex method as its solution of Linear Programming. The simplex method was come in existence in year 1951. A simplex method is an iterative process which works along the boundaries of the problems in feasible region to find a solution of the problem. Also, the simplex method still remains the widely known solution finding technique for solving Linear Programming problems. But, the available option on the bases of Linear Programming was not successful in practice. Estimation of trip distribution is a challenging task for future period. In order to compare the performance of intervening opportunity model, gravity model, intervening opportunity model Wilmot et.al (2006) was conducted a study. With the help of this comparison of observed trips and predicted trips, the study recommended that the traditional urban transportation planning trip distribution models are able to model trip distribution at the cumulative level, and that all models traditional models have achieved similar performance and they similar bottlenecks as well. Anthony Chen et.al (2012) presented a basic planning tool particularly targeted at small (Metropolitan Planning Organization) MPOs was proposed to model the system traffic for the planning applications. This tool made use of PFE (Path Flow Estimator) for both the base year estimation as well as the future year predictions with some accessible field and planning data that can be available in public domains. For this tool no formal validation is done Richter.et.al (2012) presented a model based on the logit model. The model is complex. The logit modal choice association states that the probability of selecting a mode for a trip is depend on the relative values of numerous factors such level-of-service, and travel time etc. The complex part of employing the logit modal choice model is to estimating the parameters that can be assigned for the variables presents in the utility function, so the accuracy of this logit model is not ensured. Daniel et.al 2013, developed a inter-urban trip generation model for AkwaIbom, Nigeria, which is based on the multiple regression analysis model for forecasting future patterns. However, in a trip generation model, based on regression approach is used due to the somewhat cumbersome formulation of a choice model for frequency choice. The composite variable that would represent the service characteristics of destinations is excluded. Here, the trip generation is not based on utility maximization and the interrelationship between the trip frequencies. 5. Methodology of the research work Following figure 5.1 shows the flow of work and the model development for trip generation (trip production and trip attraction) model presented in section 5.1, the model development for trip distribution model discussed in section 5.2 and model development for Mode-choice model discussed in section 5.3. Model for Trip Production Trip Production process focuses on the total number of trips produced from the city. For empirical implementation of the Trip production model, Artificial Neural Network System (ANN) is used on the available data. The model was trained using data of the year 2003 2004 and validated on data of the year 2005. Whole process of model implementation including training and validation is accomplished in the following steps. Socio-economic data of all the zones are collected. ANN in MATLAB is used to train the model on the dataset for the year 2003 and 2004. The mode model result is validated using data set for the year 2005. Finally, trip production model is used for forecasting of the Number of passengerââ¬â¢s trips production for the year 2021. 5.1.2. Model for Trip attraction Trip attraction process focuses on the total number of trips attracted by the city. For empirical implementation of the trip attraction model, Artificial Neural Network System (ANN) is used on the available data. The model was trained using data of the year 2003 2004 and validated with data for the year 2005. Whole process of model implementation including training and validation is accomplished in the following steps. Socio-economic data of all the zones are collected. ANN in MATLAB is used to train the model on the dataset for the year 2003 and 2004 and then The mode model result is validated using data set for the year 2005. Finally, trip attraction model is used for forecasting of the Number of passengerââ¬â¢s trips attraction for the year 2021. While validation, it was observed that the result produced by the model is very close to the actual data. The average error estimated during the validation phase is low and minimum error is only 0.8%. 5.2 Model development for Trip distribution Trip distribution Process traveler origins and destinations to developed a ââ¬Å"trip tableâ⬠that displays the number of trips going from every origin zone to every destination zone. Socio-economic data of all the zones are collected. Genetic Algorithm model in MATLAB is used to implement this model on the data set to compute trip distribution for all the zones in DUA. Finally, Comparisons with of results of Linear Programming model done Finally, comparison of Genetic Algorithm based trip distribution model with traditional linear programming is made. The result achieved from traditional Linear Programming Based Model is not up to the mark as the number of input variables increases linear programming based model gives infeasible solution. 5.3 Model development for Mode-choice model Mode choice Process Trip distributions zonal interchange analysis yields a set of origin destination tables followed by; mode choice analysis allows the modeler to determine which mode of transport will be used. For empirical implementation of the mode-choice model, Adaptive Neural Fuzzy Inference System (ANFIS) is used with surveyed data. The model was trained using survey data for the month February 2013 and March 2013 and validated with on the survey data for the month April 2013. Whole process of model implementation including training and validation is accomplished in the following steps. Data collection from survey at different transit stations for different time periods. ANFIS toolbox in MATLAB is used to train the model for one data set of the month February 2013 and then The model parameters are modified using the second data set of the month March 2013 and Finally the mode model result is validated using data set of the month April 2013. The model is implemented using Adaptive Neural fuzzy Inference System for peak period of work trips in Delhi urban area. The machine learning result is found quite satisfactory with validation error being as low as 0.68%. 6. Data Collection Data on house hold population and socio-economic activities such as commercial centers, Government offices, educational institutions, and health care system were collected from Delhi Transport Corporation, Delhi Development Authority, Municipal Corporation of Delhi, C.R.R.I. (Central Road Research Institute) and also for data collection survey were conducted at transit stations where passengers have option for mode choice. 7. Implementation Result For empirical implementation of the trip production and attraction model Artificial Neural Network System (ANN) is used. While validation it was observed that the result produced by these models is very close to the actual data. The average error estimated during the validation trip production and attraction model phase is low and minimum error is only 0.8%. For empirical implementation of the trip distribution model Genetic Algorithm is used. Trip Distribution model is applied on the real set of data which gives acceptable solution which is easily applicable and compared with other models such as Linear Programming model as well. The result achieved from traditional Linear Programming Based Model is not up to the mark as the number of input variables increases linear programming based model gives infeasible solution. For empirical implementation of the proposed model Adaptive Neural Fuzzy Inference System (ANFIS) is used. While validation it was observed that the result produced by the model is very close to the survey data. The average error estimated during the validation phase is low and minimum error is only 0.68%. 8. Impact of Research The transportation system being multidisciplinary system requires integration and co-ordination of various agencies. This includes STA (State Transport Authority), PWD (Public Works Department), DTC (Delhi Transport Corporation), DDA (Delhi Development Authority) and DMRC (Delhi Metro Rail Corporation) as well. The following table shows the impact of research in academics and industry. 9. Chapter wise contents Chapter 1 This chapter introduces the research subject giving its background and developments in the last decades. The objective of the present research is stated in this chapter. Chapter 2 reviews the literature on different aspects of this study and presents the contribution by different researchers and deficiencies therein. Chapter 3 presents the methodology of the research in chronological order while describing the model hypothesis and formulation in detail. This chapter also includes the description of soft computing tools used in this research. Chapter 4 describes the formulation and empirical implementation of trip production and attraction analysis for Delhi Urban Area and computational results of this work are highlighted. Chapter 5 describes the formulation and empirical implementation of trip distribution analysis for Delhi Urban Area and computational results of this work are highlighted. Chapter 6 describes the formulation and empirical implementation of mode-choice behavior modelling for Delhi Urban Area .The computational results of this work are highlighted in this chapter. Human Capital In International Companies Management Essay To expand internationally, arises different problems and challenges for HR managers in human resources department. It is more difficult to manage employees abroad, than if employees were in the home base. The growth of Wooden Bakery internationally determined new assignment and tasks. There is a need to successfully manage this for the benefit of both Wooden Bakery and the individuals. The paper observes the change from domestic to international HR management, which examines issues of culture, contracts, agreements, recruitment process, and remuneration in Wooden Bakery expansion to other countries. All the same, the paper discusses suggestions for HR managers, which involve cultural research, and the functions of selection, training, performance management and remuneration. In this new era of globalisation, international human resource management is becoming a vital concept for human resource managers to be able to practice human resources functions, starting to mention, recruitment selection, performance appraisal, compensation benefits, training development and finally employees relations. This is important for human resource managers in multinational corporations and also in domestic based human resource managers who import employees from overseas. To stay updated with the changing world, human resource managers will have to have an international vision of how to manage their individuals successfully both at home and abroad. Managing international human resources allows wooden bakery to participate more effectively in the market place, and is a developing tool for its employees. Part 1: Introduction Human Resources Definition Human Resources is not only involved in paying the employees their salaries and providing them with the benefits; however it comprises one of the organizations important resource that is the Human resource through hiring, training and developing and most importantly retaining them for the benefits of both parties. Human Resources refer to the policies, systems and employment practices that are used to attract, motivate, develop and retain firms employees. In other words, human resources is considered as an organization function, that focus on recruitment, providing career path for the people who work in the firm, and deals with personnel issues such as hiring, compensation benefits, performance appraisal, safety, employees motivation and finally training development. Human resources is no longer a traditional personnel, and administration, however Human resources role is more strategic and deal with strategic aspect, to make sure that employees contribute effectively and works in parallel with the company direction to achieve the firms goals and objectives. Human Resources functions are common to most firms, first by attracting talented people by recruiting and selection, secondly retaining talented people by wage and salary, benefits and employees relations and finally developing the people by training, development and performance appraisal. Nearly every company says ità ¢Ã¢â ¬Ã ¦ Human Resources importance and Need in International Companies The Human Resources department is important in all multinational and international companies. Recruiting and selecting is one function completed by HR, and their main responsibility is hiring and retaining companys most important asset that is our PEOPLE. Failure to do so, and lack of strong, motivated and satisfied employees, working in the right place in a firm will leads to hiring the wrong people, high turnover, employees will not do their best in their jobs and having some candidates demotivated. Thus, without good employees, the best business plan and ideas will be unsuccessful. As well, Human resources take care of all the employees concerns, make sure to solve employees issues immediately and to play the fair judge between the employee and the organization, for both sides advantage. Nevertheless, Human resources guarantee smooth functioning of the operation, good and safe working conditions and ensure that all staff is performing their jobs efficiently and toward the organization goals and objectives. Accordingly, Human Resources Manager evaluates all the employees, reward, takes disciplinary actions or dismissal. Another important role under the human resources umbrella is training and development, and creating career path for all employees, to retain and develop the existing employees, and attract new talented people, in this way the HR will improve the organization reputation, credibility and commitment from staff, thus become an employer of choice and reduce turnover. In this world of globalization, and companys expansion to other countries, Human resources adopt new cultures, and take care of all legal requirements as per the new country rules and regulations, as well as managing payroll, and other presented benefits. As per the strategic approach, human resources play an important function in developing an organization strategy, and managing the employees activities. I personally hope to be able to better my students' lives by educating them about the overall curriculum and standards brought about today and also relating the curriculum to real life situations that they might one day take part in. I hope that my students will understand that it is necessary to complete their assignments and get an education in order to have a happy and successful life. Belonging: The Crucible

Initially, Hale is the driving force of the witch trials, as he represents the theocracy, is educated and possesses books that are ââ¬Å"weighted with authorityâ⬠. This feeds his ego as the ââ¬Ëexpertââ¬â¢ and demonstrates his ability to exert power onto the townspeople. He also stresses that ââ¬Å"Theology is a fortress; no crack in a fortress may be accounted smallâ⬠. This clearly shows that you either belong or donââ¬â¢t belong in the community, and that those who choose not to belong do so at their own peril. However, Haleââ¬â¢s guilt grows throughout the play when he realises the bitterness of the accusations and metaphorically describes his actions with ââ¬Å"What I touched with my bright confidence it died, and where I turned the eye of my great faith, blood flowed upâ⬠. This evidently shows the extent to which Hale can exert power and his consequent feelings of guilt. Ultimately, Hale questions his faith and removes himself from the sense of belonging fostered in Salem. His assertion of ââ¬Å"I denounce these proceedings, I quit this court! â⬠emphasise his withdrawal from the community and decision not to conform. The same idea of power can be compared to Oliver Parkerââ¬â¢s film Dorian Gray, and suggests that there can be devastating consequences when one allows themselves to be influenced by others in order to belong. Since Dorian possesses wealth, beauty and eternal youth, he is a powerful but vain character. Being a newcomer, Dorian wants to belong and so therefore, he allows himself to be influenced by Henry Wottenââ¬â¢s hedonistic way of life. When Dorian announces ââ¬Å"Perhaps I should nail my soul to the devilââ¬â¢s alterâ⬠, he contemplates the idea of conforming in order to sustain power and belong. Dorian does eventually follow Henryââ¬â¢s example and becomes accepted by society. Parker also uses the technique of slow motion to emphasise this. When Dorian enters and announces ââ¬Å"Well here I amâ⬠, time temporarily slows in order to accentuate his power and influence. Dorianââ¬â¢s friends, who are now old and bitter, are awestruck by the sight of him. As such, his sense of belonging is heightened due to the admiration and acceptance he receives from society. However, Dorian eventually develops a conscience and recognises he has led a sinful life. Parker uses the motif of a deteriorating painting to demonstrate this. The painting reminds Dorian that he should maintain his own values and firstly belonging to himself before belonging to society. As a result, he realises the negative consequences of trying to conform and loses his power by destroying the painting as a sign of self-belonging. Isolation is another idea explored in The Crucible, suggesting that indivuals can face barriers to belonging, which therefore lead to feelings of alienation. Abigail and her circle of friends are the ones who feel the most loneliness since they are young and unmarried. This forces them to secretly rebel and dance in the woods. For Abigail, the need for acceptance is shown through her affair with John Proctor. Miller juxtaposes love and lust to highlight their differences. Abigailââ¬â¢s exclamation of ââ¬Å"You loved me John Proctor, and whatever sin it is, you love me! â⬠shows her repetition of the word ââ¬Ëloveââ¬â¢. However, Proctor only uses ââ¬Ëlustââ¬â¢ to describe their relationship. As a result, the audience sees that Abigail is a character who is constantly rejected with a desperate need to belong. Furthermore, Abigailââ¬â¢s crying of ââ¬Å"Child! How do you call me child! â⬠emphasise her failed attempt at belonging, and suggests that the only way for a woman to be accepted in society is to be a wife. John Proctor is the opposite of Abigail and ultimately chooses not to belong. His words ââ¬Å"I cannot mount the gibbet like a saint. It is a fraud. I am not that manâ⬠are metaphorical and signify his rejection of the Salem justice system. Although he believes he is unworthy of anything due to his affair with Abigail, Proctor eventually finds ââ¬Å"a shred of goodnessâ⬠in himself by maintaining his own values and choosing to belong to himself. His redemption is also shown through Millerââ¬â¢s stage directions. The drumroll crash and streaming sunlight in the final scene contrasts with previous scenes and signifies that he has done the right thing by choosing to die and belong to himself rather than sign himself to lies. In comparison to The Crucible, Oodgeroo Noonuccalââ¬â¢s poem We Are Going also conveys themes of isolation. Similarly to Abigail, the Aboriginal persona faces a barrier to belonging. The alienation of which the persona feels is due to the white settlers and the consequential loss of culture and identity. ââ¬Å"Many white men hurry about like antsâ⬠is an example of a simile that suggests that the settlers are busy and stressed. This is a contrast to traditional aboriginal life, and shows the differing perspectives between the settlers and the narrator. Here, the juxtaposition of the two ethnic groups is parallel to Abigail and Proctorââ¬â¢s view on love and lust, and reinforces the idea of isolation. Furthermore, Noonuccal uses repetition, particularly with the word ââ¬Å"Goneâ⬠to emphasis the lost feelings of belonging. Noonuccal writes: ââ¬Å"The scrubs are gone, the eagle is gone, the bora ring is goneâ⬠to stress the loss of culture and connection with the land. The poem also uses collective first-person narration to give the audience a personal understanding on the frustrations of not belonging. ââ¬Å"We are goingâ⬠are the three words in the title and conclusion. It implies that the aboriginals are not welcome in their homeland and will let go of the past and their old ways. This echoes the idea of belonging to oneââ¬â¢s self, which is found in The Crucible. Like Proctor, the aboriginals choose not to conform and decide to leave in order to preserve their individuality and ââ¬Å"self belongingâ⬠.
